Labor and Employment

We have represented both employers and, on a carefully selected basis, executive and highly compensated officers and employees or unions in a wide variety of employment disputes including but not limited to (i) fiduciary duty, trade secret and non-compete/non-solicitation, (ii) bonus, commission and other compensation disputes, (iii) sexual harassment and the full range of employment discrimination, (iv) all other forms of wrongful termination, and (v) all other statutory rights including wage and hour, family medical leave, ERISA, labor relations, etc. In addition to litigation, our clients regularly involve us in the negotiation and drafting of employment conracts, employment policies and separation agreements.

Business Litigation

S&L's attorneys have successfully tried many actions in federal and state court as well as before arbitration panels. Our Business Litigation attorneys are experienced at handling any dispute between, or involving, business entities including contracts disputes, fraud claims, deceptive trade practices, trade mark infringement, as well as real estate and construction disputes.

Business disputes have become increasingly complex, requiring flexible procedural solutions. As an example, we have represented lawyers sued in connection with their transaction work with public securities both in both federal class actions and in bankruptcy adversary proceedings brought by creditors' committees. Multiple forums in complex cases are increasingly common. For example, we recently represented equity holders and directors in a dispute with other equity holders and directors in three different forums: arbitration, Texas state court and Kansas federal court.

We pride ourselves on preparation. We involve the client in every stage of the process. While we will always be ready to effectively represent our clients at trial, we also appreciate that trial is not always the best solution, and we are dedicated to working with our clients to economically achieve the best outcome possible under the circumstances.

Bankruptcy

S&L's bankruptcy section practices all aspects of bankruptcy law with a heavy emphasis on bankruptcy litigation and representation of debtors and trustees. Several members of the section are former panel trustees. All members of the bankruptcy section have extensive experience in creditor representation.

S&L's bankruptcy section represents clients in all phases of the bankruptcy process, from pre-bankruptcy counseling to post-confirmation matters. The practice is concentrated in representation of secured and unsecured creditors, including leasing and other contract-based claimants, with a heavy emphasis on protecting the client's collateral and lifting the stay early in the proceeding. The firm has nationwide expertise in the areas of creditors' committee representations, restructuring transactions, sophisticated preference and recovery litigation, and insurance company representation in Chapter 11 reorganizations and Chapter 7 liquidations.
